NR Classico delivery conditions

ARTICLE 1. DEFINITIONS

ARTICLE 2. APPLICABILITY

1. These Terms and Conditions shall apply to every offer, quotation and agreement between NR Classico and a client to which NR Classico has declared to apply these Terms and Conditions, insofar as the parties have not expressly deviated from these Terms and Conditions in writing.

2. The terms and conditions concerned shall also apply to agreements between NR Classico and any third parties engaged by NR Classico for delivery.

3. These general conditions are also written for the employees of NR Classico and its management.

4. Applicability of any purchase or other conditions of the customer is expressly rejected.

5. If these provisions or several provisions of these general terms and conditions are at any time declared partially or completely null and void, the rest of these general terms and conditions will continue to apply. In the event of such an event, NR Classico and the customer will consult in order to agree on new provisions for the provisions that have been declared null and void in whole or in part. These will then be compiled and replaced with the utmost respect for the aims and scope of the original provisions.

6. If any uncertainty exists regarding the interpretation of this or several provisions of these general terms and conditions, interpretation should be made in the spirit of these general terms and conditions.

7. If situations arise between the parties that are not covered by these general terms and conditions, such situations must be assessed in the spirit of these general terms and conditions.

8. If NR Classico does not continuously request strict compliance with these terms and conditions, this does not imply that the provisions therein would not apply, or that NR Classico loses its rights to strict compliance with these terms and conditions in any way or to any extent in other cases.

9. NR Classico reserves the right to change the general terms of delivery and content of its website.

ARTICLE 3. OFFERS AND QUOTATIONS

1. All quotations and special offers from nrclassico.com are without obligation, unless the quotation states a deadline for acceptance. An offer or quotation expires if the product to which the offer or quotation relates is no longer available in the meantime.

2. NR Classico cannot be held to its quotations or offers if the customer could reasonably be expected to have recognised in quotations or offers, or any part thereof, an obvious mistake or error in writing.

3. Prices mentioned in the webshop and/or in a quotation are including VAT, excluding packaging, shipping and handling costs, unless otherwise indicated.

4. If the acceptance (either by the provisions below or otherwise) differs from what is included in the quotation or special offer, NRclassico.com is not bound. In that case, the acceptance is not in accordance with the quotation or offer, unless nrclassico.com indicates otherwise.

5. Compound price quotations do not oblige NRclassico.com to perform a part of the order at a proportionate amount of the quoted price. Special offers or quotations do not automatically apply to future orders.

6. Special offers do not automatically apply to repeat orders.

ARTICLE 4. ORDER CONFIRMATION AND AGREEMENT

1. After NR Classico receives the order, NR Classico will confirm the order as soon as possible, except in cases where NR Classico cannot reasonably be expected to comply with the agreement with the customer. NR Classico reserves the right not to accept an order and therefore not to confirm the order, for whatever reason. Reasons are not limited to: product stock, problems in receiving an order, or problems in completing an order. However, there may also be other problems that may lead to the rejection of an order.

2. As soon as NR Classico has received an order, the customer will be informed by e-mail about the availability of the products ordered. If a product is (temporarily) undeliverable, consultation with the customer will follow. After consultation with the customer, the final order will be agreed and confirmed by NR Classico. The customer must pay in advance to receive the ordered goods.

3. In exceptional cases, some goods of the agreed and paid order may, for whatever reason, become unavailable. In such a case, the currently undeliverable products will be put on backorder. Delivery (transport) costs related to a backorder delivery shall be borne by the customer. The customer has the right to refuse a backorder delivery. The customer must notify NR Classico by e-mail. In such a case, the customer will be credited for the value of the goods of the backorder.

4. This agreement contains all agreements between the customer and NR Classico, and supersedes all previous agreements, arrangements and/or understandings between the customer and NR Classico

5. Subject to proof to the contrary, NR Classico's records shall constitute valid proof of orders awarded and of payments made to NR Classico by the Customer, and of deliveries made by NR Classico, recognising that electronic communications may serve as proof. By accepting these General terms and conditions the customer acknowledges this as well.

ARTICLE 5. PRICES

1. The total amount, mentioned on the order confirmation, is final and includes the prices of the ordered products, processing thereof, packaging material and transport.

2. Within the EU, duties or taxes are bound by European Regulations.

3. NR Classico will send a separate invoice to the address submitted by the customer only by the customer's explicit request.

4. NR Classico is entitled to change prices and correct any errors. If the customer ordered based on a (protected) published price list and the prices were scheduled to be changed, the customer will be informed by e-mail. If a price change was made upwards, the customer has the right to cancel the order within the next two days. NR Classico cannot be held liable for any (printing) errors in its prices or conditions.

ARTICLE 6. DELIVERY

1. In case of an order accepted by NR Classico, the goods will be presented to DPD as soon as possible, who will then deliver the package to the address indicated by the customer, unless otherwise agreed with the customer in previous written consultation.

2. Delivery times given to the customer, via written consultation, are indicative and no guarantee. Parcels may be subject to unexpected delays by the postal services. NR Classico has no control over this, and cannot be held liable for such delays. Any delays incurred at the customs of the relevant country are at the customer's risk.

3. The delivery time begins when the package is submitted to DHL or other postal services.

4. If a parcel (concerning export from the Netherlands) has not arrived within the specified period, no action will be taken for at least four weeks. The reason for this is that the delayed shipment can often still be delivered within that period.

5. For deliveries outside the EU, any import duties for certain products are the responsibility of the customer. The customer should be aware of the import regulations in his/her country prior to ordering. NR Classico has no control over this and cannot be held liable.

6. Any costs related to the delivery shall be borne by the customer.

7. The customer is obliged to accept the purchased goods at the time when they are made available or transferred to him.

8. If the customer refuses to accept the goods, or is negligent in providing instructions or the correct address, the goods intended for delivery will be stored at the customer's own risk. Any additional costs for repeated deliveries or storage of these goods will be charged to the customer.

9. Not all shipments will automatically be insured. Insurance of a shipment depends on the value and/or content of the shipment as well as the customer's requirements. If, after consultation with NR Classico and the customer, insurance of a shipment is agreed upon, in case a shipment has gone missing or damaged during transport, NR Classico will request an investigation with the relevant carrier.

10. NR Classico can only comply with the delivery agreement with the customer if the customer has provided NR Classico with the relevant data necessary for delivery.

ARTICLE 7. GUARANTEE

Every NR Classico article meets the highest quality standards. In the unlikely event of defects during normal use, we will repair the article. After our assessment this may involve replacement or repair. The warranty covers manufacturing and/or material defects. Naturally, normal wear and tear is not covered by the guarantee.
Warranty conditions:
  • In the event of an unfounded complaint, the costs incurred shall be borne by the customer;
  • If a complaint is justified, NR Classico will decide whether the item will be (partially) repaired or (partially) replaced or (partially) credited;
  • An item returned for warranty review must be clean and dry. Damp or dirty clothing will not be processed;


No warranty claims can be made for:
  • Damage caused intentionally, or by negligence;
  • Improper use or negligent maintenance;
  • Normal wear and tear;
  • Damage due to non-compliance or incorrect compliance with the operating instructions;
  • Damage caused by nature, man or animal.


Warranty outside the Netherlands
Products eligible for warranty but in use abroad can be returned by agreement. However, both the cost of shipment to NR Classico and the return shipment to the customer are the responsibility of the owner of the item.

ARTICLE 8. RECEIPT

1. The customer is obliged to inspect the delivery (or have it inspected later) immediately at the time the goods are made available to him, or at the time the transport services concerned have delivered the delivery. With these inspections, the customer is obliged to examine whether the quality and/or quantity of the delivered goods corresponds to what has been agreed and meets the requirements agreed by the parties with regard to the delivery. NR Classico shall within 48 hours of their discovery, by e-mail info@nrclassico.comThe client shall be informed if any defects are found, quoting the number shown on the delivery note.

2. If the customer receives deliveries with clearly damaged packaging and/or the customer suspects that the packaging contains damaged contents, the following action must be taken:1. The customer is obliged to take photos of the delivery as it was delivered.2. The customer is obliged to indicate on the receipt or delivery note that the delivery has been delivered with damage.

3. The customer is obliged to demand a copy of the receipt / delivery note (or make a copy). The company that delivered the goods can then leave.

4. The customer is obliged to check the contents of the packages immediately. If the contents of the shipment are damaged, the customer is obliged to report this damage to NR Classico in as much detail as possible, within 48 hours, supplemented by photographic evidence. Only then can claims of damaged goods be accepted and investigated by NR Classico. The customer is obliged to allow NR Classico to investigate, or have investigated, a complaint.

5. Goods can only be returned after consultation with NR Classico and a written consent from NR Classico.

6. In case damaged goods are returned by the customer, transport costs will be borne by the customer. Replacement of the damaged goods, will be for NR Classico.

ARTICLE 9. LIABILITY

1. In cases where NR Classico is liable, such liability shall be limited to that set out in these provisions.

2. If goods delivered by NR Classico are not in good condition, NR Classico's liability is limited to what is regulated in our general terms and conditions under "guarantees".

3. NR Classico is limited to replacing the delivered goods in case of consequential damage or for the refund of the purchase price.

4. The customer bears personal responsibility for his or her choice of products, their storage and handling. NR Classico is not liable if the losses incurred are the result of intentional, culpable and/or culpable actions, or injudicious or improper use by the customer.

5. NR Classico is not liable for damages of any kind that may have been or are caused by incorrect and/or incomplete information provided by the customer.

6. NR Classico is liable for direct damages only in case of obvious lack of care for transport packaging, deliberate non-compliance with rules of conduct with written agreed customer agreements.

7.NR Classico shall never be liable for indirect damages, including consequential damages, lost profits, missed savings and losses due to business stagnation and/or other types of stagnation.

8. In any case, NR Classico's liability is limited to the amount paid by the insurer if any.

9. NR Classico cannot be held liable for printing, writing and/or typing errors, incorrect interpretations of product information, offers, order confirmations or invoices, incorrect use of products and/or materials, nor for the consequences thereof.

10. The included limitations of liability in this article do not apply if the losses are due to intent, or gross negligence of NR Classico.

ARTICLE 10. TRANSFER OF RISK

Risks from loss or damage of the products, which are the subject of this agreement, are transferred to the customer at the moment that these products are legally and/or factually delivered to the customer, or to third parties named by the customer.

ARTICLE 11. PAYMENT

1. No rights can be derived from incorrect prices and/or images.

2. Payment must be made through the payment methods offered on the quotation and/or the NRclassico.com webshop. Processing and shipment of the ordered goods will take place after payment by the customer.

3. NR Classico will never make customer data available to third parties and acts in accordance with Dutch legislation (including the Personal Data Protection Act).

ARTICLE 12. RIGHT TO DISSOLVE THE AGREEMENT

1. The customer has, after purchase, for a period of 14 working days the right to cancel the purchase, without giving reasons. NR Classico must be notified in writing within 7 working days of the purchase. Any costs for returning the goods shall be borne by the customer.

2. The customer can only cancel the purchase without giving any reason if the goods concerned can be returned complete, undamaged, unused and in their original packaging.

3. The customer is fully responsible for the return, the method of shipment and any insurance of the shipment.

4. If, after a return to NR Classico, it appears that there is damage to the return packaging, or that the returned products do not comply with the stipulations under two of this article, NR Classico will inform the customer of this within two working days.

5. Paragraph 1 of this article does not apply to Accessories and Out-of-Sales.

ARTICLE 13. COMPLAINTS

If delivered goods do not meet the customer's expectations due to breakage, damage, or wrong delivery, the customer is obliged to notify NR Classico within 48 hours of receiving the goods. If NR Classico does not receive a complaint within this 48-hour period, it is considered that the deliveries were in accordance with the order.

ARTICLE 14. INTELLECTUAL PROPERTY

1. NR Classico reserves all rights and powers belonging to it under the Dutch Copyright Act (Auteurswet), and any other laws and intellectual property legislation.

2. NR Classico is owner and/or licensee of all copyrights, database applications, (own) trademarks and other intellectual property rights on this website. Concept, structure, layout and design are the exclusive property of NR Classico.

3. If the above items are used by the customer, this will only be done by him or her, and will not be reproduced, published or brought to the attention of third parties without the prior written consent of NR Classico.

ARTICLE 15. FORCE MAJEURE

1. Neither NR Classico, nor the customer, shall be held to fulfil any of their obligations if they are prevented from doing so due to circumstances that cannot be attributed to fault, and if the obligations would be contrary to the legislation in force, a legal act or parts thereof.

2. In addition to what is meant by force majeure as such in the law and jurisprudence, these Terms and Conditions interpret force majeure as external causes, foreseen or unforeseen, which NR Classico cannot influence, and as a result of which NR Classico is unable to fulfil its obligations.

3. NR Classico reserves the right to invoke force majeure if the circumstances as described above are in force after NR Classico was expected to fulfil its obligations.

ARTICLE 16. APPLICABLE LAW AND DISPUTES

1. All legal relationships to which NR Classico is a party, even if the relationship is wholly or partly based abroad or if the party involved in the legal relationship is a resident of a foreign nation, shall be judged solely on the basis of Dutch law. Applicability of the UN - Convention on the International Sale of Goods is excluded.

2. Before the parties appeal to the courts, they will make every effort and do their utmost to settle a dispute by mutual agreement.

Shipping

Please note that due to COVID-19, delivery may take longer than usual. We hope for your understanding.

Free delivery on orders from €300.00. Delivery time is two weeks.

Netherlands and Belgium
Orders up to € 299.00 = € 8.95
Orders above € 300.00 = free delivery

If an order cannot be delivered due to incorrect or incomplete (delivery) address information, we will charge delivery costs.

Worldwide delivery options may vary. Please review the available options in the checkout.

Returns

If you are not satisfied with a purchase, you can return it without giving any reason within the trial period of 14 working days. We will then refund the purchase price of the returned items within 7 days of receipt of the return. Download the return form.

Return conditions
A return must meet the following conditions:

  • the return shipment is accompanied by the original packing slip and return form.
  • Clothing must be returned in the shipping box in which you received it or in another sturdy box to ensure that the original box remains in optimal condition. If not, we will charge extra.
  • the articles are clean and complete.
  • the items have not been washed, altered or damaged.
  • the items are in a condition consistent with normal 'fitting' - as you would fit in a regular store.
  • the articles are packed in the original, undamaged packaging.
  • All original labels and tags are still attached to the item.

Returns
Via your nearest DHL Parcelshop. Use the enclosed DPD return label and stick it over the original shipping label. Deliver the return at the nearest DHL Parcelshop. The cost of handling the return is € 5.95 and will be deducted from the purchase price. Send your package to the following address:

Exchange
Unfortunately we cannot exchange products. If you wish to exchange a product, you can return it free of charge using the enclosed return form and return sticker. You can then place a new order in the webshop. This way you can be sure that the desired item(s) are in stock. Refund After receiving the return we will process the refund in the system as soon as possible. The processing costs of € 5.95 will be deducted from the refund.

1. How long will it take for my order to be delivered?

If you have placed your order on working days (Mon-Fri) before 20:30 hours and the payment has gone through, we will hand over the package to DPD within 2 days. Often you can have your order delivered the next working day! This means that you never have to wait long for your order.

2. How can I track my order?

To be able to follow your order online, you will receive a personal track & trace code via e-mail. Press the link in the e-mail to follow your order closely.
Received a track & trace but the link does not work? This may be because the track & trace code only works when DPD has actually scanned the package. We advise you to try again later or the next day.
If your track & trace link does not show any information, the package has unfortunately been incorrectly sorted by DPD. It may take a few days before the parcel is sorted correctly.

3. Can I pick up my order myself?

No, that is not possible. While ordering, there is no possibility to have your package delivered at a DPD Servicepoint. However, when you have received the track and trace code, you can indicate on the website of DPD that you want the package to be delivered to a DPD Servicepoint, the neighbors, or you can arrange another time with the deliveryman.

4. How can I pay at the NR Classico webshop?

You pay for your order at the NR Classico webshop safely and easily via Sisow. You can pay with iDEAL, PayPal and Apple Pay, among other methods. You can also pay afterwards. If you choose iDEAL, you can pay via all banks affiliated with iDEAL.

5. What are the shipping costs?

Shipping costs differ per country. Check the shipping costs per country on the shipping page.

6. I have not received an order confirmation.

There is a chance your order confirmation was delivered to your spam folder. Please check this and if you still can't find the confirmation, please contact our customer service.

7. How can I return something?

If you are not satisfied with a purchase, you can return it without giving any reason within the trial period of 14 working days. We will then refund the purchase price of the returned items within 7 days of receipt of the return. Check the return conditions here.

8. Warranty

Every NR Classico article meets the highest quality standards. In the unlikely event of defects during normal use, we will repair the article free of charge. After our assessment this may involve replacement or repair. The warranty covers manufacturing and/or material defects. Naturally, normal wear and tear is not covered by the guarantee.

Warranty outside the Netherlands
Products eligible for warranty but in use abroad can be returned by agreement. However, both the cost of shipping to the NR Classico webshop and the return shipping to the customer are the responsibility of the owner of the item.
